Hemra — Terms of Use (EULA)

These Terms of Use govern your use of Hemra, a migraine and headache diary for iPhone. By downloading or using the app you accept them. Hemra is also licensed under Apple's standard End User License Agreement, the Licensed Application End User License Agreement; where the two differ, the stricter protection for you applies.

What the app is

Hemra records headache and migraine attacks, symptoms, medication and daily context on your own device, and turns that record into a report you can hand to a clinician.

What the app is not

Hemra is not a medical device. It does not diagnose, does not recommend medicines or doses, and does not predict attacks.
It does not replace a doctor. Any decision about treatment is between you and a qualified clinician.
The medication-overuse counter reports your own recorded days against the published ICHD-3 §8.2 thresholds. It is a count, not a clinical judgement.

Your data

Your diary is stored only on your device. There is no account and no server holding your records; deleting the app deletes the data with it, and keeping a backup is your responsibility. See the Privacy Policy for the full detail.

Free use, and what Pro costs

Hemra can be used free for a three-day trial period. After that, continued use of the app requires Hemra Pro, sold through Apple's in-app purchase system:

Hemra Pro Monthly — US$4.99 per month, an auto-renewable subscription.
Hemra Pro Yearly — US$29.99 per year, an auto-renewable subscription.
Hemra Pro Lifetime — US$69.99, a one-time purchase that is not a subscription and does not renew.

Prices shown are the United States prices; in other countries the App Store charges the local equivalent, shown to you before you confirm the purchase. There is no introductory or free-trial offer attached to the subscriptions.

Auto-renewing subscription terms

Payment is charged to your Apple Account when you confirm the purchase.
The subscription renews automatically for the same period (one month or one year) unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account is charged for the renewal within the 24 hours before the current period ends.
You can manage the subscription and turn off auto-renew at any time in iOS Settings → your name → Subscriptions.
Cancelling stops the next renewal; access continues to the end of the period you already paid for. Apple does not refund the unused part of a current period.
Purchases can be restored free of charge with "Restore" on the purchase screen.
Billing, refunds and subscription management are handled by Apple under the App Store terms.

Acceptable use

Use Hemra for your own health record, or that of someone you care for with their agreement. Do not attempt to decompile, resell or redistribute the app.

Liability

To the extent permitted by law, Hemra is provided "as is", without a warranty that it will be uninterrupted or error-free. The developer is not liable for indirect damages arising from use of the app, including data loss caused by device failure, deletion of the app, or the absence of a backup.

Changes

These terms may change to reflect changes in the app. The version in force is the one published at this address, with the date above.
